En este artículo se presenta una revisión bibliográfica de la novela Terra nostra, de Carlos Fuentes, y propicia diálogos que evidencian su actualidad y su relación interdisciplinar con la filosofía, la historia, el arte, la sociedad y la cultura. En los criterios estructurales se distinguen estas temáticas: mito e identidad, relaciones con el otro, imagen y memoria, y la reconstrucción de lo que somos y seremos. Se tuvieron en cuenta franjas temporales de ocho años, desde el momento de su publicación, (...) 1975, hasta el año 2015. Los estudios destacan los problemas de la identidad latinoamericana, la intertextualidad, la multiculturalidad y la conquista; revelan su actualidad en el siglo XXI a través del mestizaje, las tradiciones culturales del Viejo y el Nuevo Mundo, y los otros mundos; y expresan, así, la necesidad de reconstruir un nuevo humanismo. The Uniform Determination of Death Act (UDDA) provides that “an individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead.” We show that the UDDA contains two conflicting interpretations of the phrase “cessation of functions.” By one interpretation, what matters for the determination of death is the cessation of spontaneous functions only, regardless of their generation by artificial means. By the (...) other, what matters is the cessation of both spontaneous and artificially supported functions. Because each UDDA criterion uses a different interpretation, the law is conceptually inconsistent. A single consistent interpretation would lead to the conclusion that conscious individuals whose respiratory and circulatory functions are artificially supported are actually dead, or that individuals whose brain is entirely and irreversibly destroyed may be alive. Requiring family authorization for apnea testing subtracts health professionals control over death determination, a procedure that has traditionally been considered a matter of clinical expertise alone. In this commentary, we first provide evidence showing that health professionals’ (HPs) disposition to act on death determination without family’s prior consent could be much lower than that referred to by Berkowitz and Garrett (2020). We hypothesize that HPs may have reservations about their own expertise as regards death, and may thus hesitate to impose (...) their views on patients’ families. We then address the theoretical question of clinical expertise in death determination by distinguishing judgments about facts (e.g., the presence or absence of spontaneous breathing) from interpretations given of these facts (i.e., their meaning for the vital status of an individual). We argue that, while clinicians may claim some expert authority on the former, they hold no particular authority on the latter. (shrink)

This article addresses the general ethical issues of accessing online personal data for research purposes. The authors discuss the practical aspects of online research with a specific case study that illustrates the ethical challenges encountered when accessing data from Kooth, an online youth web-counselling service. This paper firstly highlights the relevance of a process-based approach to ethics when accessing highly sensitive data and then discusses the ethical considerations and potential challenges regarding the accessing of public data from Digital Mental Health (...) services. It presents solutions that aim to protect young DMH service users as well as the DMH providers and researchers mining such data. Special consideration is given to service users’ expectations of what their data might be used for, as well as their perceptions of whether the data they post is public, private or open. We provide recommendations for planning and designing online research in an ethical manner that includes vulnerable young people as research participants. We emphasise the distinction between public, private and open data, which is crucial to comprehend the ethical challenges in accessing DMH data. Among our key recommendations, we foreground the need to consider a collaborative approach with the DMH providers while respecting service users’ control over personal data, and we propose the implementation of digital solutions embedded within the platform for explicit opt-out/opt-in recruitment strategies and ‘read more’ options. La voz humana es un fenómeno ampliamente estudiado desde una gran variedad de disciplinas, desde las especialidades de la medicina hasta las artes. Aunque esta situación resulta enriquecedora, la multiplicidad de perspectivas ha conspirado contra la formulación de una concepción única de la voz y de un sistema lógico que pueda ayudar a entender los fenómenos asociados con ella en términos más generales, enfatizando continuidades y relaciones en lugar de requerir cada vez una definición del objeto de estudio de acuerdo (...) con las herramientas conceptuales y las metodologías de cada disciplina. La semeiotica de Peirce ofrece una alternativa a esta fragmentación de los estudios de la voz, especialmente a través de su taxonomía de signos relacionada con las categorías faneroscópicas. El nonágono semiótico es un modelo operativo que, adoptando la forma de un ícono diagramático, ayuda a aplicar las categorías peirceanas al análisis de conceptos, objetos o disciplinas en general. Con el nonágono semiótico como herramienta metodológica, este artículo ofrece una forma de analizar, describir y categorizar de acuerdo con criterios lógicos los múltiples usos de la voz humana. Se espera que las relaciones que revela entre usos radicalmente diferentes de la voz ayuden a reducir la redundancia entre disciplinas y a proveer nuevas direcciones para la investigación en otras áreas, así también como para cubrir potenciales necesidades pedagógicas y analíticas en las artes y otras disciplinas. Alireza Bagheri supports a policy on organ procurement where individuals could choose their own definition of death between two or more socially accepted alternatives. First, we claim that such a policy, without any criterion to distinguish accepted from acceptable definitions, easily leads to the slippery slope that Bagheri tries to avoid. Second, we suggest that a public discussion about the circumstances under which the dead donor rule could be violated is more productive of social trust than constantly moving the line (...) between life and death. Ruben Berrios Queen’s University Belfast Anti-realism and Aesthetic Cognition Abstract At the core of the debate between scientific realism and anti-realism is the question of the relation between scientific theory and the world. The realist possesses a mimetic conception of the relation between theory and reality. For the realist, scientific theories represent reality. The anti-realist, in contrast, seeks to understand the relations between theory and world in non-mimetic terms. We will examine Cartwright’s simulacrum account of explanation in order to illuminate (...) the anti-realist position. Science consists of phenomenological and theoretical laws. The former are concerned with appearances, or those phenomena that can be directly observed; the latter involve the unobservable reality that is alleged to underlie appearances, and are capable only of indirect confirmation. Phenomenological laws are said to be descriptive, whilst theoretical laws are understood as explanatory. Cartwright is concerned with the theoretical. She claims that the standard realist account of the explanatory efficacy of theoretical laws is faulty. The explanatory power of theoretical laws consists in their ability to provide an explanation of physical phenomena. According to Cartwright, the realist claims that laws explain phenomena by providing an abstract description of them, in terms of their micro-structural features, that is alleged to be true. On this view, explanatory power is entirely dependent on descriptive adequacy. As phenomenological laws describe appearances, so theoretical laws describe the fundamental reality that governs appearances. Cartwright rejects the preceding view and in its place proposes a simulacrum account of explanation. According to Cartwright, the explanatory power of theoretical laws is related not to descriptive adequacy, but rather to the construction of adequate models. To explain a phenomenon is to construct a model which best or most adequately accommodates the phenomenon to a theory. The model will consist of various posited objects that serve to explain the phenomena in terms that are consistent with a set of theoretical laws. Cartwright claims that theoretical laws are true of, or describe, the objects of the model. The objects of the model, however, are not descriptive of reality. They are simulacra. They have, that is, the form or appearance of things, without possessing their substance or proper qualities. In light of the foregoing account we can summarise the distinction between scientific realism and anti-realism as follows. The realist claims that theoretical laws literally represent real objects. The anti-realist claims that laws represent objects of a model that are simulacra of reality. Anti-realism has an aesthetic dimension. The movement from realism to anti-realism is also the movement from the mimetic conception of the scientist as holding a mirror to nature to the constructionist view of the scientist as engaging with nature through invention. There is a lot of the artist in the anti-realist’s view of the scientist. This is true for Cartwright as well as, for example, Van Fraassen in his doctrine of constructive empiricism. It would appear, then, that the philosophy of science has absorbed some concepts that are ordinarily housed in aesthetics. And it has done so profitably. The aim of this paper is to reverse the direction of disciplinary influence. Can art, in relation to its status as a cognitive enterprise, be illuminated by scientific anti-realism? I will argue that it can. In an unexpected reference to the Nicomachean Ethics, Cartwright draws a suggestive parallel between theoretical laws and general moral principles, on the one hand, and physical phenomena and everyday moral conduct, on the other hand. If we add to this the claim that a central component of art’s value is cognitive, then we have the basic materials with which to flesh out a broadly anti-realist view of art. In the production of art, artists can construct models that mediate between everyday ethical phenomena and general ethical tendencies. These models reveal the ways in which there are implicit consistencies or inconsistencies, conflicts or congruences and so forth, between the phenomena and the tendencies. On this basis art can contribute to the reflective understanding of ethical life. This constitutes to a large degree art’s status as a cognitive enterprise. To apprehend art cognitively as artist or critic is to engage in aesthetic cognition. (shrink)

This paper argues that Spinoza held substances other than God to be inconceivable. It uses this claim to develop a novel response to the Problem of Other Substances, the problem of explaining why some of Spinoza’s proofs for God’s existence cannot be used to prove the existence of a non-divine substance instead.

One of the foundational problems of biochemistry concerns the conceptualisation of the relationship between the composition, structure and function of macromolecules like proteins. Part of the recent philosophical literature displays a reductionist bias, that is, the endorsement of a form of microstructuralism mirroring an out-dated biochemical conceptualisation. We shall argue that such microstructuralist approaches are ultimately committed to a potentialist form of micro-predeterminism whereby the macrostructure and function of proteins is accounted for solely in terms of the intrinsic properties and (...) potentialities of the components of the primary structure as if they were self-contained or essentially immutable entities. We shall instead suggest that a conceptualisation of the relationship between proteins’ composition, structure and function consistent with contemporary biochemical practice should account also for the causal role of the cellular, organismal and environmental relations in protein development. The analysis of the folding process we propose suggests that microstructure-laden reductionist approaches are ontologically indefensible. Rather than a potentialist form of micro-predeterminism, our analysis ultimately supports a relational-construction-based view of protein development and potentialities formation, which requires an indispensable analysis of the dynamical interplay between the micro-level of the parts and the macro-level of the relational structures of their systems. Los resultados indicaron que la mayor producción de estudios fue en 2021, con predominancia de idioma inglés, España como el mayor productor, Reino Unido con el mayor número de revistas y el uso de realidad aumentada como la estrategia más estudiada. Moral Constraints on War offers a principle-by-principle presentation of the transcultural roots of the ethics of war in an age defined by the increasingly international nature of military intervention.

The link between leadership and mental health at the workplace is well established by prior research. However, most of the studies have addressed this relationship from a single-source perspective. The aim of this study was to examine how supervisor and employee ratings of health-oriented leadership correspond to each other and which sources are predictive for employee mental health. We assessed data within 99 teams containing 713 employees in 11 different companies in Southern Germany. Supervisors and their staff completed questionnaires on (...) the supervisors’ health-oriented staff-care dimensions awareness, value of health and health behavior and current mental distress. Hierarchical linear models revealed that supervisors’ self-ratings were significantly related to their employees’ ratings only on the health behavior dimension, but not on the health awareness and value of health dimensions. Also, supervisors rated themselves significantly higher on HoL compared to their employees. Employee ratings of HoL significantly predicted their own level of mental distress, whereas supervisor ratings of HoL did not predict employees’ mental distress at the team level. Supervisors’ self-ratings of HoL did not influence the relationship between employee ratings of HoL and their mental distress on an individual level. These results highlight the complex relationship between multisource assessments of HoL and employee mental health, emphasizing the importance of subjective perception for mental health. Future studies should investigate under which conditions supervisor and employee ratings correspond to each other and are predictive for mental health at the workplace. (shrink)

Most of the features of modern Russian business are transient, determined by the transitional character of the Russian economy and drastic changes in the social structure, ideology, and consciousness of Russian society in general. There are three main normative experiences in the traditions of Russian business: a) the experience of pre-Revolutionary business, specifically developed and practiced by the merchants of the old-believers extraction; b) the experience of socialist economy, which was more or less oriented to the public good and presupposed (...) selfless aspirations by the economic agents; c) the experience of legally and administratively constrained private business and illegal shadow business, which expected businessmen to be vigorous, industrious and enterprising. The process of privatization was developed under the aegis of state, specifically the state bureaucracy. The influence of changes in the social-economic system has been ambivalent for social morals. However, the reforms could stimulate their improvement. The recent development in the cultural environment of business testify to the emerging space of civilized business, which manifests that it is practically useful for businessmen to be ethical. En este artículo se presenta un abordaje general de la teoría de la justicia social de John Rawls. Revisamos algunas críticas desde diversos frentes teóricos. Consideramos que la justicia social permite enjuiciar las consecuencias regresivas para la humanidad del capitalismo en su fase neoliberal y comenzar a imaginar otros mundos posibles.

Researchers have studied the athletes' dual careers with the aim of helping them to combine the sport and the academic–vocational sphere. Most of this research has addressed the study–sport combination, but there is a lack of studies on the work–sport combination. The main objective of this research was to explore the subjective perceptions of Spanish elite athletes when attempting to combine their careers as professional athletes with a second profession or trade. Further, this study aims to identify the access to (...) facilitating resources and the perception of obstacles and barriers to the development of a dual career. A qualitative approach was chosen to address these research questions. Interpretative phenomenological analysis was carried out on a sample of 18 elite athletes, and the data were collected using semi-structured interviews based on a set of superordinate and subordinate categories. The results showed that the athletes interviewed possessed valuable resources such as the transference of sports values to the work sphere. However, important barriers were highlighted such as the perception of sport institutions as absent entities in the work–sport combination. Thus, the study of this type of dual career seems to be one of the challenges facing the interested scientific community for the coming years. (shrink)

The idea of sociability - a person’s disposition and ability to communicate and live in the community - goes through the whole history of philosophy. Due to the peculiarity of translations, this term and the whole tradition related to it have been lost to the Russian reader. The article discusses some tendencies in comprehending the idea of sociability in early modern moral philosophy. The key to this consideration is F. Hutcheson’s essay On the Natural Sociability of Mankind, the title of (...) which contains the very term “sociability” and which presents the main essential points in a discussion of the issue in the first third of the 18 th century. One can distinguish two main approaches to the problem. According to one of them, sociability determined by various human natural needs is the basis of social relations, and a person becomes a moral agent as a social being (H. Grotius, T. Hobbes, S. Pufen-dorf, B. Mandeville). According to another approach, sociability is a manifestation of a person’s natural tendency to care for the good of others, and its consistent implementation leads to the formation of community and supports its stability (Cambridge Platonists, Shaftesbury, Hutcheson, J. Butler, D. Hume, A. Smith). Representatives of both approaches recognized contradiction in manifestations of sociability or in its nature. I. Kant theoretically overcame the confrontation between these approaches and conceptualized the contradiction and associated it with the human nature. According to Kant, the “unsociable sociability” is given in the fact that a person has a tendency to sociability but also a tendency to self-assertion at the expense of others. However, despite the presence of asocial features (evil principle), Kant considered the person’s inherent sociability (good principle) as a prerequisite for culture and as one of the most important conditions of possibility of morality. El artículo analiza el concepto de mal radical de Kant y sostiene que su explicación del mal utiliza un modelo reconstructivo que niega la atribución de los modelos de adicción o del mal hábito. Se critica la tesis de la “revolución en la disposición moral fundamental”, primero, porque Kant abandona el método fenomenológico-trascen- dental y, segundo, por el carácter semipelagiano de su argumentación.

El llamado “retorno de la religión” puede interpretarse como un hecho inédito, un pretexto fáctico o una enmienda. Se muestra que no se trata de lo primero, pues fue un problema político para la filosofía del siglo XX, ni de lo segundo. Consiste en un arrepentimiento implícito de la teoría política por haber asumido el secularismo y el positivismo como marco epistemológico y normativo. Este concepto conduce, además, a reformular la utopía secularista y a la emergencia de la postsecularidad.

This book is about some topical philosophical and methodological prob lems that arise in the study of behavior and mind, as well as in the treatment of behavioral and mental disorders. It deals with such questions as 'What is behavior a manifestation of?', 'What is mind, and how is it related to matter?', 'Which are the positive legacies, if any, of the major psychological schools?', 'How can behavior and mind best be studied?', and 'Which are the most effective ways of (...) modifying behavioral and mental processes?' These questions and their kin cannot be avoided in the long run because they fuel the daily search for better hypotheses, experimental designs, techniques, and treatments. They also occur in the critical examination of data and theories, as well as methods for the treatment of behavioral and mental disorders. All students of human or animal, normal or abnormal behavior and mind, whether their main concern is basic or applied, theoretical or em pirical, admit more or less tacitly to a large number of general philosophi cal and methodological principles. In the context of his advanced theory of ethics Aristotle like later Kant seems considering the Golden Rule as trivial and not bound to be articulated. It is possible that Aristotle did not feel necessity to mention the Golden Rule, because the very Golden Rule was spread out in his ethics. Though he did not use the formula ofthe Golden Rule in his texts, he often expressed his understanding of virtuous character and virtuous relations using intellective constructions evidently relevant to (...) the Golden Rule. The analysis of Aristotle’s reasoning on shame, social intercourse and, mainly, friendship shows that his ethics is saturated with the content andspirit of the Golden Rule, including such features agent’s initiative, activity, commitment and thus her/his responsibility for establishing relations, their potential reversibility, mutuality, and universalizability. The article analyzes the concept of universality in Oleg Drobnitskii’s ethics. As opposed to most Soviet ethicists of the 1960s and early 1970s, Drobnitskii viewed this concept along the lines of the principle of universality presented in the moral theories of Immanuel Kant and Richard Hare. However, while they considered universality to be a feature of individual moral thinking in the forms of maxims, principles, and evaluations, Drobnitskii understood universality as the main feature of moral requirements and essentially external to (...) the moral agent, representing to her social relations and the ‘general laws of history.’ It was conceptually significant in Drobnitskii’s approach to universality that he analyzed it within the context of a more general concept of morality—as a mode of normative regulation of behavior. In this capacity, universality was presented as a characteristic of general appeal, or the general way in which a moral requirement is binding. The principle of equality is a normative correlate of universality understood in this way. Universality also characterizes judgments, whose moral adequacy is verified through the procedure of universalization. Regarding universality, Drobnitskii discussed important questions of the individualization of the universal moral requirement in the form of the moral agent’s personal task and the universality of class moral views. He tried to explain these differing, and not always interconnected, aspects of universality by appealing to certain ‘general laws of history,’ and thus offered a historicist basis of morality. This article shows that, despite this unprecedented analysis of the issue of universality, Drobnitskii did not achieve a systematic conclusion in his conceptualization of universality. Nevertheless, he was able to offer a number of significant insights, with the potential to aid our further comprehension of the phenomenon of universality and how it ought to be understood. (shrink)

Ethics in the USSR revived in the middle of the twentieth century after more than twenty years of silence. The impetus for the development of research and teaching in this area was given by the supreme power, which considered ethics as one of the more effective tools of state propaganda, corresponding to the new social realities. But pretty soon, the very logic of research immersion in the subject required ethicists to deepen the philosophical and normative analysis of morality. This ultimately (...) led to the revision of the postulates of orthodox Soviet social science and to the formation of a strict moral theory within its framework. The latter, by the very fact of its appearance, called into question the agenda of moralizing ideologization. The renewal of Soviet ethics proceeded in several directions, but in theoretical perspective, the key one was the turn from understanding morality as a form of ideological superstructure (which was dogmatically asserted in historical materialism), to understanding it as a way of regulating human behavior with specific functional characteristics. Today one can trace that transition by a number of intermediate steps in the interpretation of morality, the reconstruction of which, based on the texts of the 1950s to early 1970s, is of interest not only in the context of the history of ideas, but also in terms of the development of the methodology of ethical research and understanding of how a rigorous moral theory can be formed. Some episodes of the history of Soviet ethics are relevant today as examples of emancipated thought and intellectual opposition to the domination of state ideology. (shrink)

A principios de los años 80 se desató en Francia una polémica conocida como «el silencio de los intelectuales». En este texto abordaremos la singular postura de Michel Foucault al respecto. Para ello realizaremos una doble operación. Por un lado, planteamos la hipótesis siguiente: se pueden encontrar los fundamentos que sostienen su posición en los análisis que realizó sobre la parrhesía a partir de los años 80. En segundo lugar, realizaremos un recorrido por autores como Lyotard y Blanchot, quienes intervinieron (...) en dicha polémica con conocidos escritos, para mostrar las particularidades de la apuesta de Foucault. De esta manera, pretendemos, no solamente mostrar su original aportación al problema, sino señalar los desplazamientos respecto a la crítica del intelectual que había elaborado durante los años 70.
